Introduction
EU Member States had until 17 December 2021 to implement into their national legislation the EU Directive 2019/1937 on whistleblowers adopted on 23 October 2019.
This new framework was largely expected following several cases of whistleblowers which highlighted the need for a balanced protection. Protecting people who report some legal wrongdoings is an important element of internal control of any organisation or regulatory supervision. Whistleblower retaliation is perceived by the public as unfair and reputation damage can be serious for a firm if not properly handled. Several studies show that the number of employees who would consider using a whistleblowing mechanism increases significantly when an effective non-retaliation policy is embedded in the corporate value of a company.
