Description
This training program provides an understanding of the fundamental principles of civil liability and motor insurance.
It covers the distinctions between civil and criminal liability, as well as tortious and contractual liability, along with the rules of the Civil Code.
Participants will learn about motor liability legislation, the role of the stakeholders, and the impact of claims on premiums.
Special attention is given to Luxembourg institutions and to assistance services as a complement to insurance coverage.
Objectives
Understand the difference between civil liability and criminal liability
Understand the difference between tort liability and contractual liability
Understand how Articles 1382 and 1384, paragraph 1 of the Civil Code operate
Master and understand the limits of insurability of liability
Know how to identify and place a specific law within the legal framework
Master motor third-party liability (MTPL / Auto Liability) legislation and know how to identify insured parties and third parties in a motor claim, as well as the impact of a claim settlement on the insurance premium
Have an overall view of the various European directives and the stakeholders involved in the claims settlement process
Understand motor insurance coverage as a whole
Learn the purpose and functioning of the Luxembourg Bureau, the Motor Guarantee Fund, and the High-Risk Pool
Develop a clear and structured approach to assistance as a complement to insurance coverage
